This Information Text has been prepared by “SİNAN AKYÜREK” as the data controller in accordance with Article 10 of Law No. 6698 and the Communique on the Procedures and Principles for Fulfilling the Obligation to Inform.

1- Personal Data Processed by the Data Controller

The following personal data of yours may be processed by “SİNAN AKYÜREK” as the data controller in accordance with the Personal Data Protection Law No. 6698 (“Law”) for the purposes explained below.

The personal data collected by “SİNAN AKYÜREK” may be processed for the purposes listed below, which include the reasons you disclosed your personal data to us, in accordance with the personal data processing conditions specified in Article 5 of the Law.

Ensuring the Security of Movable Assets and Resources

3- Who Your Processed Personal Data May Be Shared With and for What Purpose

Your collected personal data may be shared with relevant public institutions and organizations authorized by law, within the scope of the personal data processing conditions and purposes specified in Article 8 of Law No. 6698, for the realization of the above-mentioned purposes.

4- Methods and Legal Grounds for Collecting Your Personal Data

Your personal data is collected by “SİNAN AKYÜREK” through security cameras. Images are recorded through security cameras located at the entrance door and corridors of our service building. The personal data collected during this process is processed automatically, based on the legal ground stated in Article 5 of the Law, which is “it is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.”

5- Application to “SİNAN AKYÜREK” for the Rights of the Data Subject

If you, as a data subject, have any requests regarding your rights mentioned in Article 11 of the Law, you can fill out the Personal Data Protection Application Form available at the Front Office according to the specified procedures and principles, or submit your application to us via email at drsinanakyurek@gmail.com, signed with a mobile or electronic signature, or send a written application with a wet signature to our address at “Harbiye Mah. Teşvikiye Cad. No:19/13 ŞİŞLİ/ISTANBUL”. We will resolve your application free of charge within the shortest possible time and at the latest within thirty days, depending on the nature of your request. However, if the process incurs additional costs, “SİNAN AKYÜREK” will charge a fee according to the tariff determined by the Personal Data Protection Board.

In this context, as a data subject, you have the following rights:

a) Learn whether your personal data is being processed,

b) Request information regarding the personal data being processed,

c) Learn the purpose of processing personal data and whether they are used in accordance with that purpose,

ç) Know the third parties to whom personal data has been transferred, both domestically and internationally,

d) Request the correction of personal data if it is incomplete or incorrect,

e) Request the deletion or destruction of personal data within the conditions specified in Article 7 of the Law,

f) Request that the operations carried out according to paragraphs (d) and (e) be notified to the third parties to whom personal data has been transferred,

g) Object to the results of the processing of personal data exclusively through automated systems, which leads to unfavorable consequences for the individual,

PERSONAL DATA PROCESSING INFORMATION TEXT

OBJECTIVE AND SCOPE

This information text has been prepared in accordance with the Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”) and the European Union General Data Protection Regulation (“GDPR”), with the aim of informing data subjects about the procedures and principles regarding the processing of personal data of patients/visitors applying to Dr. SİNAN AKYÜREK Clinic and employees/interns working at the Clinic.

PRINCIPLES REGARDING THE PROCESSING OF PERSONAL DATA

Dr. SİNAN AKYÜREK, as the Data Controller, processes your personal data within the framework of the following principles.

2.1 Processing in Compliance with Law and Integrity

Your personal data is processed in accordance with the principles set out by legal regulations and the general rules of security and honesty.

2.2 Ensuring Personal Data is Accurate and, When Necessary, Up-to-Date

Considering your legitimate interests, periodic checks and updates are conducted to ensure that processed data is accurate and up-to-date, and necessary precautions are taken accordingly. In this context, systems are being created within Dr. SİNAN AKYÜREK to check the accuracy of personal data and make necessary corrections.

2.3 Processing for Specific, Clear, and Legitimate Purposes

Your personal data is processed based on clear, specific, and legitimate data processing purposes.

2.4 Being Related, Limited, and Proportional to the Purpose for Which They Are Processed

Your personal data is processed in a manner that is proportional, related to the purpose, and limited to the achievement of the specified purpose, and personal data that is unrelated or unnecessary for achieving the purpose is not processed.

2.5 Retaining Personal Data for the Period Required by Relevant Legislation or the Purpose for Which It Was Processed

Your personal data is retained only for the period required by relevant legislation or the purpose for which it was processed. In this context, it is first determined whether a retention period is specified in the relevant legislation; if a period is specified, it is followed accordingly, and if no period is specified, personal data is retained for the duration necessary for the purpose for which it was processed. If the retention period expires or the reasons for processing no longer exist, and if there is no legal reason allowing for a longer retention period, your personal data will be deleted, destroyed, or anonymized according to Dr. SİNAN AKYÜREK’s Personal Data Storage and Disposal Policy.

PERSONAL DATA PROCESSING CONDITIONS

Your personal data is processed by Dr. SİNAN AKYÜREK within the framework of the following conditions.

3.1 Explicitly Foreseen in Laws

In cases where the processing of personal data is explicitly foreseen in laws, your personal data may be processed.

3.2 Inability to Obtain the Data Subject’s Explicit Consent Due to Physical Impossibility

If a person is unable to express their consent due to physical impossibility or if their consent cannot be recognized as valid, personal data may be processed when it is necessary to protect the life or bodily integrity of the person or another person.

3.3 Directly Related to the Establishment or Performance of a Contract

Personal data may be processed when it is necessary for the establishment or performance of a contract directly related to the parties of the contract.

3.4 Dr. SİNAN AKYÜREK Fulfilling Legal Obligations

Personal data may be processed when necessary for Dr. SİNAN AKYÜREK, as the data controller, to fulfill its legal obligations.

3.5 Publicly Disclosed Personal Data

If your personal data has been made publicly available by you, it may be processed.

3.6 Necessity for Processing Personal Data for the Establishment or Protection of a Right

Your personal data may be processed when necessary for the establishment, exercise, or protection of a right.

3.7 Processing Based on Legitimate Interests

Your personal data may be processed when necessary for the legitimate interests of Dr. SİNAN AKYÜREK.

3.8 Processing Based on Explicit Consent

If your personal data cannot be processed based on any of the conditions specified in these Principles, it will be processed based on your explicit consent.

YOUR PERSONAL DATA TO BE PROCESSED

The following Personal Data and Special Categories of Personal Data will be processed by Dr. SINAN AKYÜREK in accordance with the fundamental principles set out in Articles 4 of the KVKK and 5 of the GDPR, and the Personal Data Processing Conditions and Purposes outlined in Articles 5 and 6 of the KVKK and Articles 6 and 9 of the GDPR, while ensuring compliance with the purposes stated in this Clarification Text. These will be processed in a lawful manner, related to the purpose of processing, limited and measured, in accordance with the principles of fairness and transparency, accurately and up-to-date, and all necessary technical and administrative measures as foreseen by the relevant legislation will be taken to ensure data security.

4.1 Your Identity Information: Your name, surname, Turkish Identity Number and/or Passport Number and/or Temporary Turkish Identity Number, place and date of birth, marital status, gender, profession, signature, and other identity data that can identify you.

4.2 Your Contact Information: Your address (residence/workplace), phone number (fixed and/or mobile phone numbers you provided), email address, IP address, social media accounts, and other communication data.

4.3 Your Health Information: Your blood type, allergies, chronic diseases, sexually transmitted diseases, infectious diseases, information about previous surgeries/operations, medications you regularly use, Covid-19 information, your medical treatments, health reports, test and imaging results, prescription information, body analysis and measurement data, skin analysis data, harmful health habits, and other health data necessary for treatments and medical applications to be performed on you.

4.4 Your Photographs and Video Recordings: Photographs and/or videos taken before, during, and/or after medical procedures.

4.5 Your Financial Information: Your bank account number, IBAN number, credit card information, billing and invoice information, and other financial data.

4.6 Your Transfer and Accommodation Information: If you are a Health Tourist under International Health Tourism, your transfer information, flight ticket round-trip details, and hotel accommodation details.

PERSONAL DATA PROCESSING PURPOSES

Your Personal Data will be processed in accordance with the following purposes: to create a patient file, to conduct examination, preventive healthcare, medical diagnosis, treatment, and care services, to carry out your controls after medical diagnosis and treatment processes, to manage possible complications, to communicate with you directly, to manage appointment processes, to implement patient satisfaction and request management, to fulfill legal and contractual obligations, to store health data that must be kept according to relevant legislation within the specified periods, to consult other relevant specialists when necessary to ensure the proper execution of your treatment, to fulfill legal obligations under International Health Tourism regulations, to plan transfer and accommodation services for patients/clients coming under Health Tourism, to announce innovations in medical treatment and applications, to inform third parties about the medical procedures applied, to carry out promotional activities related to medical services under the Health Tourism Promotion Legislation, to plan and manage health services and their financing, to fulfill responsibilities arising from the legal relationship between the doctor and patient, to fulfill financial and administrative obligations, to ensure technical and commercial security, and to fulfill public obligations. This will be done in accordance with KVKK and GDPR by Dr. SINAN AKYÜREK.

Your Personal Data will be processed by Dr. SINAN AKYÜREK under the following circumstances and conditions:

5.1 Your Identity Data: Will be processed to carry out examination, preventive healthcare, medical diagnosis, treatment, and care services, to create a patient file, to implement patient satisfaction and request management, and to plan transfer and accommodation services for patients/clients under Health Tourism.

Your Contact Information: Will be processed to conduct your follow-up after medical diagnosis and treatment, to manage appointment processes, and also, with your explicit consent, to announce, inform, and promote innovations in medical treatment and applications, to remind about recurring treatments, and to congratulate you on special days.

5.2 Your Health Information: Will be processed to carry out your medical treatments successfully, to consult another specialist when necessary, to create a patient file, to store health data that must be kept according to relevant legislation within the specified periods, and to fulfill legal obligations under applicable Health Law and Health Tourism regulations.

Your Photographs, Videos, and Audio Recordings: Will be processed by Dr. SINAN AKYÜREK to monitor and manage the treatment process, and, with your explicit consent, to inform and promote about the medical procedures applied to you for Health Tourists coming to receive treatment in our country under International Health Tourism.

Your Financial Data: Will be processed to monitor payment transactions, issue invoices, and process refunds if there are any overpayments.

5.3 Your Transfer and Accommodation Information: Will be processed to plan transfer and accommodation services for patients/clients under Health Tourism.

The aforementioned Personal Data and Special Categories of Personal Data will be processed in accordance with the above-mentioned purposes and regulations to carry out your medical treatment and fulfill the associated obligations. If you fail to provide the relevant personal data, the legal obligations of Dr. SINAN AKYÜREK as the doctor providing the treatment will not be fulfilled, and your treatment and/or recovery process will not be carried out successfully.

PERSONAL DATA TRANSFERRED TO OTHERS AND FOR WHAT PURPOSES

Your Personal Data collected within the conditions and purposes specified in Articles 5 and 6 of the KVKK and Articles 6 and 9 of the GDPR will be transferred in accordance with Articles 8 and 9 of the KVKK and Articles 45 and 49 of the GDPR. This transfer will occur for purposes such as conducting medical diagnosis, treatment, and care services, managing complications, consulting other specialists, fulfilling administrative obligations under International Health Tourism regulations, planning transfer and accommodation services for Health Tourists, and carrying out promotional activities in line with Health Tourism Promotion Legislation. These data will be transferred to authorized public institutions and organizations, judicial authorities, insurance companies, financial advisors, health and safety companies, legal consultants, audit firms, and relevant partners, including service providers and translators, as necessary.

METHOD AND LEGAL BASIS FOR COLLECTING PERSONAL DATA

Your Personal Data may be processed through verbal, written, camera, and photo recordings by individuals or legal entities authorized by Dr. SINAN AKYÜREK, in accordance with the necessary technical and administrative security measures and KVKK and GDPR provisions. In cases where applicable, explicit consent will also be obtained.

SECURITY OF PERSONAL DATA

Dr. SINAN AKYÜREK will take all necessary technical and administrative measures to ensure the security of your personal data as per the relevant regulations.
